The Bacolod City government is preparing to file criminal charges against Artemis Salt Corporation for allegedly constructing an illegal structure that blocked a drainage outfall in Barangay Banago, contributing to flooding in nearby communities.
City Legal Officer Atty. Karol Joseph Chiu confirmed that their office is coordinating with the City Engineer’s Office, the Department of Public Works and Highways, and the Office of the Building Official (OBO) to finalize documentation of violations committed by the salt processing firm.
“Once the investigation is complete, we will proceed with legal action, including a possible criminal complaint against the owner,” Chiu said.
The case stems from findings that Artemis Salt Corporation built a concrete barrier near a drainage system without securing the proper permits.
Although the company was issued a building permit, Chiu said it failed to comply with Presidential Decree 1096, or the National Building Code of the Philippines, due to faulty plans and non-observance of the required easement.
As part of enforcement action, the City Legal Office and its enforcement team dismantled the illegal structure on July 30.
The concrete wall — measuring roughly one meter long and six centimeters tall — was reportedly constructed to block seawater intrusion but ended up restricting stormwater outflow.
Mayor Greg Gasataya, who personally inspected the area, said the obstruction worsened flooding in Sta. Clara Subdivision and nearby residential zones.
“They built a wall without the necessary fencing permit and in violation of building codes. That obstruction had to be removed to restore proper drainage,” Gasataya said.
