Bacolod SP OKs ‘Right to Care’ ordinance on first reading

The Bacolod Sangguniang Panlungsod (SP) has approved on first reading a proposed ordinance that seeks to strengthen patient rights and recognize non-traditional caregivers in healthcare settings.

The measure aims to institutionalize a more inclusive and patient-centered healthcare support system in the city.

The proposed ordinance would allow competent adults to formally designate a trusted healthcare partner, caregiver or representative who may assist them during hospitalization, emergencies, illness, disability, or incapacity.

Councilor Caesar Distrito said the measure recognizes the realities faced by many Bacolodnons who rely on companions or chosen family members who may not be legally recognized relatives but play vital roles in their care and support.

“This ordinance is about dignity, compassion and respect for patient autonomy,” Distrito said, noting that senior citizens, persons with disabilities, LGBTQIA+ individuals, solo individuals, and people living alone are among those who could benefit from the proposed policy.

Under the ordinance, residents may designate healthcare representatives through notarized documents, healthcare authorization forms, advance healthcare directives, or through a digital registration system under the city’s proposed Right to Care Program.

The measure also seeks to recognize hospital visitation rights of designated healthcare partners, strengthen emergency healthcare coordination, prevent discrimination in medical settings, establish a secure digital registry and verification system, and provide sensitivity training for healthcare institutions.

It also includes provisions for complaint and grievance mechanisms in cases involving violations of patient rights.

The proposed ordinance directs the City Health Office to implement the Right to Care Program in coordination with the City Legal Office, several city government offices, healthcare institutions, and civil society organizations.

The authors said the measure is anchored on constitutional guarantees protecting human dignity, equality, health, and privacy, as well as existing national laws safeguarding vulnerable sectors.

If enacted, Bacolod will join other local government units nationwide that have adopted “Right to Care” policies aimed at promoting inclusive healthcare and compassionate governance./CJ, WDJ
