A junk shop recently filed a case against Silay City government officials claiming they were not awarded a waste disposal contract from the city despite claiming to have won the bidding process.
Court records show the Franklyn Junk Shop, owned by Franklin and Analyn Posa, is seeking an injunction and damages from Silay City Mayor Mark Andrew Golez; members of the Disposal Committee, including Atty. Ryan Montoro, Ramon Dumancas, Salvador Melgar, Elsie Jimenea, Dela Ledesma, and Kent Torres; and Raul Belleza, authorized representative of Errol Mariah Enterprises, the company awarded the disposal contact.
According to the complainants’ legal counsel, Atty. Archie Baribar, they are preparing criminal and administrative charges, along with filing a case before the Office of the Ombudsman in violation of RA 3019, or the Anti-Graft and Corrupt Practices Act.
The complainants claimed they won the bidding, which was conducted on October 27, 2017, after presenting the “highest bid” of P3,704,793. They also provided a photograph affirming them as the winning bid, which has since been submitted as ‘Annex E’ of their complaint.
They also presented a certificate of deposit valued at over P5.5. million, which Baribar noted, proves the couple was “financially qualified.”
He added, “When my client submitted her bank certificate, the Disposal Committee Office refused to receive it.”
Meanwhile, Errol Mariah Enterprises submitted a bid of P3,043,170.
Golez and the other respondents could not be reached for comment as of press time./DGB, WDJ
