The Bureau of Internal Revenue-Region XII (BIR-12) recently filed five separate complaints with the Office of the Ombudsman-Visayas against Negros Occidental Registers of Deeds (RD) head Romulo Gonzaga and Bacolod City RD head Bonifacio Kho in connection with their participation in five separate realty transfers conducted without a BIR certificate authorizing registration (CAR).
A CAR is needed to formally transfer property from buyer to seller, along with affirming all proper taxes were paid.
Gonzaga was charged on three separate complaints for allegedly allowing the transfer of titles to Ludorico Hilado, and subsequently to the HH&C Agricultural Corporation; Florentino Perez; and Xenia Esteban.
Kho was brought up on two charges surrounding the transfer of property to Megaworld Bacolod Properties, Inc. and Jose L. Vasquez.
According to the complaints, their actions allowed the said parties to evade the payment of corresponding capital gains taxes and documentary stamp taxes.
